GENERAL CONDITIONS OF SALE
PREAMBLE
The following provisions establish the general conditions of sale of the products offered by the company " FRAGRANCE PUR " on its website " www.fragrancepur.com ".
"FRAGRANCE PUR" is a "Microenterprise" whose head office is located in Longvic Email : " contact [at] fragrancepur.com ".
Article 1 - Application
These general conditions of sale are intended to govern the contractual relationship between "www.fragrancepur.com", hereinafter referred to as "FRAGRANCE PUR", and any person making a purchase through the site "www.fragrancepur.com", hereinafter referred to as the buyer.
By becoming a member and/or client, membership of " FRAGRANCE PUR " implies full and unreserved acceptance of all the general conditions of sale by checking the box set up for this purpose.
Reciprocally, " FRAGRANCE PUR " undertakes to respect the obligations incumbent upon it within the framework of the present sales conditions.
"FRAGRANCE PUR" reserves the right to modify its general conditions of sale at any time. In this case, the applicable conditions shall be those in force at the date of the order placed by the buyer.
Article 2 - Registration
It is not mandatory to be registered to access all the products on sale on the site, except for special operations. Membership is acquired only after identification.
"FRAGRANCE PUR" reserves the right to accept or refuse a member or to review access rights at any time.
The new member receives a confirmation email, to the email address previously filled in the form, which validates his/her registration to "FRAGRANCE PUR".
The member then has a personal account on which he can make purchases.
The member is fully responsible for the use and conservation of his password.
In case of loss, theft or communication of your password to a third party, the member is invited to reset his password.
By registering with "FRAGRANCE PUR", the member agrees to receive by email invitations to sales and newsletters and/or offers from partner organisations and companies.
Article 3 - Products

"FRAGRANCE PUR" is committed to providing the most accurate pictures possible.

Personalized products cannot be returned or refunded.
The products offered for sale are sold for an indefinite period by "FRAGRANCE PUR" and within the limits of available stocks.
Article 4 - Prices
The prices displayed on " FRAGRANCE PUR " are indicated in euros and include all taxes.
The prices of the products do not include the contribution to the shipping costs, except for special operations.
The amount of the contribution to shipping costs varies according to the country of destination.
The amount of shipping costs is indicated at the time of validation of the order and is subject to acceptance by the buyer. If the delivery is said to be free, the product will not be subject to shipping costs.
"FRAGRANCE PUR" reserves the right to modify its prices at any time, it being understood, however, that the products will be invoiced on the basis of the rates in force when the order is registered.
Article 5 - Terms of order
Orders can only be placed on " www.fragrancepur.com ".
All buyers declare and guarantee that they have the legal capacity to order on " FRAGRANCE PUR ".
The buyer certifies, at the date of the order, that he/she is at least 18 years old or that he/she has the legal authority to make a purchase on " FRAGRANCE PUR ".
The buyer also guarantees that he is fully entitled to use the bank card provided for the transaction and that it is not a card used in a fraudulent manner, then undertakes to ensure that it is sufficiently funded to cover the purchases made.
Any purchase made on " www.fragrancepur.com " shall be deemed to have been made by the user of the account. All the data recorded by " FRAGRANCE PUR " constitute the proof of the transactions made by the buyer on " www.fragrancepur.com ".
The order is validated only when the buyer has made a double click, in accordance with the law on confidence for the digital economy of June 21, 2004: a first time to place the order and a second time to confirm it.

Article 6 - Terms of payment

In case of refusal of the bank, the order will be automatically suspended and "FRAGRANCE PUR" will take care to inform the buyer by phone or email and refund him within 48 hours.
Furthermore, "FRAGRANCE PUR" reserves the right to refuse any order from a buyer with whom there is a dispute.
Article 7 - Security of payments
"FRAGRANCE PUR" uses the SSL (Secure Socket Layer) security system, which consists of encrypting all banking information using software.
No third party has access to confidential payment information.
Therefore, the bank details of the member, wishing to make purchases by credit card, will be required for each new order.
In any case and following a payment on " Fragrance Pur ", " FRAGRANCE PUR " does not keep or collect the confidential banking data of its customers. The credit/debit card number is never kept.
Only the partner bank retains the card number and expiry date.
In addition, the bank is the only bank to have the most effective fraud control, alert and blocking modules on the market, thus protecting all the confidential data linked to the payment method.
Article 8 - Unavailability of products
Despite all the precautions implemented, a product ordered and purchased may be unavailable.
In the event of unavailability of a product ordered before the end of the shipment of the latter, "FRAGRANCE PUR" informs the buyer by email, within a maximum of one week, how soon the product could be delivered.
In case of permanent unavailability, "Fragrance Pur" undertakes to offer an exchange, a credit note or a full refund of the product, by automatic transfer to the account with which the buyer has paid his order, as soon as possible, at the latest within thirty days from the date of payment of the order.
An email will be sent to the buyer to inform them that their card has been credited and that their purchase is now refunded.
Article 12 - Intellectual Property
All elements of the site " www.fragrancepur.com " are and remain the exclusive intellectual property of " FRAGRANCE PUR ".
In this respect and in accordance with the provisions of the intellectual property code, no one is authorised to reproduce, exploit, redistribute or use for any purpose other than private, even partially, without the agreement of "FRAGRANCE PUR".
Any simple or hypertext link, using the "framing" or "deep linking" technique to the "www.fragrancepur.com" site is strictly prohibited.
"www.fragrancepur.com" or any other part of this site is strictly forbidden to be reproduced, copied and exploited for any purpose whatsoever without express written permission.
Any copy, use for commercial reasons and any parasitism based on the same sales method as "FRAGRANCE PUR" is strictly forbidden and may give rise to legal proceedings and sanctions, in terms of violation of intellectual property rights.
Article 13 - Confidential data
All information and data of members is strictly confidential.
"FRAGRANCE PUR" undertakes to use this information exclusively for the operation of its site.
In this respect, "FRAGRANCE PUR" does not undertake to market or rent to a third party all the data concerning the members.
Members have the right to access, modify and suspend data concerning them. To do this, the member can exercise it by writing online in the contact section. "FRAGRANCE PUR" undertakes to immediately remove members who wish to leave its database.
The Site and the Application make use of cookies. A cookie is a computer file stored on the hard disk of the Client's computer or telephone. The Buyer is informed of the possibility of resorting, in the event of a dispute resulting from an online or in-store purchase, to a conventional mediation procedure or any other alternative dispute resolution method, if such a dispute could not be settled in the context of a prior claim directly submitted to "FRAGRANCE PUR".
