Article 10 - Right of withdrawal, Returns and Refunds

10.1. Right of withdrawal

Exercising the right of withdrawal

The Buyer has a period of 14 days to exercise his right of withdrawal and return at his own expense and without reason, the Product(s) he ordered (excluding personalized Products).

This period runs from the date of delivery of the Products to the delivery address indicated by the Buyer (and in the absence of the latter, from the date of first presentation of the package containing the Products).

The Buyer shall inform " FRAGRANCE PUR " of his decision to withdraw by sending an e-mail to the address contact [at] fragrancepur.com.

Return of Product(s) when exercising the right of withdrawal (excluding personalized Products)
The Product(s) must be returned by the Purchaser to "FRAGRANCE PUR" no later than 14 days following the communication by the Purchaser of his/her decision to withdraw, in its (their) original packaging (which may have been opened), unworn, following the following steps " "

Refund of Product(s) returned when exercising the right of withdrawal
If the above-mentioned conditions are met, "FRAGRANCE PUR" will reimburse the Buyer for the total amount of his/her order (excluding personalized Products), it being understood that the cost of returning the Products remains the Buyer's responsibility.

This refund will be made within 14 days from the date on which "FRAGRANCE PUR" was informed of the Buyer's decision to withdraw.

However, if "FRAGRANCE PUR" does not receive the returned Products or proof of shipment by the Buyer within this period, the reimbursement of the Products will be deferred to the earlier of these two dates: the receipt by "FRAGRANCE PUR" of the Products or the receipt by "FRAGRANCE PUR" of the proof of shipment of the Products by the Buyer

In accordance with article L221-18 of the Consumer Code, the consumer has a period of fourteen days to exercise his right of withdrawal from a contract concluded at a distance, following a telephone canvassing or off-premises, without having to give reasons for his decision or to bear any costs other than those provided for in articles L. 221-23 to L. 221-25 of the Consumer Code.

The 14-day period runs from the day :
1° Of the conclusion of the contract, for contracts for the provision of services and those mentioned in article L. 221-4 of the same code;

2. On receipt of the goods by the consumer or a third party, other than the carrier, designated by the consumer, for contracts for the sale of goods. For contracts concluded off-premises, the consumer may exercise his right of withdrawal from the conclusion of the contract.

In the case of an order for several goods delivered separately or in the case of an order for a good composed of multiple lots or parts whose delivery is staggered over a period of time, the time limit shall run from the receipt of the last good or lot or part.

In the case of contracts providing for the regular delivery of goods during a specified period of time, the period shall run from the time of receipt of the first goods.

10.2. Returns and Refunds

Without prejudice to the provisions of the legal guarantee, nor to the right of withdrawal, the Buyer has a period of 14 days to return, at his expense, any Product(s) he has ordered if he is not satisfied with them (except for personalised Products).

This period runs from the date of delivery of the Products to the delivery address indicated by the Buyer (and in the Buyer's absence, from the date of first presentation of the parcel containing the Products).
The Buyer wishing to return the Products must go to the "Returns and Refunds" section of the Site in order to request a return, or send an email to customer service at "contact [at] fragrancepur.com", who will inform the Buyer of the procedure to follow.

After having carried out this step of return on the Site, the Purchaser will have to return the Product(s) in its (their) packing and its (their) packing of origin (which can have been opened) not worn (s), not washed (s) by following the steps below " ".

If the above conditions are met, "FRAGRANCE PUR" will reimburse the Buyer, within fourteen 14 days of receipt of the latter's request for return, the amount of the returned Product(s), it being understood that the delivery and return costs of the Product(s) concerned remain the responsibility of the Buyer.

Article 11 - Warranty and Liability

All our Products benefit from legal guarantees, as long as they have been used normally and that the maintenance advice has been followed.

Legal guarantee of conforming delivery

In accordance with Article L211-4 of the French Consumer Code, the seller is required to deliver goods in conformity with the contract and is liable for any defects in conformity existing at the time of delivery. He is also responsible for defects in conformity resulting from the packaging, the assembly instructions or the installation when the latter has been put at his charge by the contract or has been carried out under his responsibility.

Pursuant to article L211-5 of the French Consumer Code, in order to conform to the contract, the goods must:
1º Be fit for the use normally expected of similar goods and, where applicable : - correspond to the description given by the seller and possess the qualities that the seller has presented to the buyer in the form of a sample or model; - present the qualities that a buyer may legitimately expect in view of the public statements made by the seller, by the producer or by his representative, notably in advertising or labelling;

2º Or present the characteristics defined by mutual agreement between the parties, or be suitable for any special use sought by the buyer, brought to the attention of the seller and accepted by the latter.
Information on legal warranties of conformity and latent defects
In accordance with Article 1641 of the French Civil Code, the seller is bound by a warranty against latent defects in the item sold, which render it unfit for its intended use, or which impair this use to such an extent that the buyer would not have purchased it, or would have paid a lower price for it, had he or she been aware of them.

In the event of an action under the legal warranty of conformity:
- The buyer has a period of 2 years from delivery of the goods to take action (Article L211-12 of the French Consumer Code).
- The buyer may choose between repair and replacement (Article L211-9 of the French Consumer Code). However, the seller may not proceed according to the buyer's choice if this choice entails a cost that is manifestly disproportionate to the alternative, given the value of the good or the importance of the defect. In this case, he is obliged to proceed, unless this is impossible, according to the method not chosen by the purchaser.
- The purchaser is exempted from proving the existence of a lack of conformity for a period of twenty-four (24) months following delivery of the goods (Article L211-7 of the French Consumer Code).
- The legal warranty of conformity applies independently of the commercial warranty granted by "FRAGRANCE PUR" under article 8 of these general conditions of sale.
- In the event that the warranty against latent defects is invoked:
- The purchaser has the choice of returning the item and having the price refunded, or keeping the item and having part of the price refunded, as arbitrated by experts (Article 1644 of the French Civil Code).
- The action resulting from redhibitory defects must be brought by the purchaser within two years of the discovery of the defect (Article 1648 paragraph 1 of the French Civil Code).
In the event of non-conformity or a defect affecting one or more Products within the aforementioned time limits, the Purchaser may return the Products by contacting "FRAGRANCE PUR" customer service by email at "contact [at] fragrancepur.com", who will confirm the procedure to be followed.

If the above conditions are met, "FRAGRANCE PUR" will exchange the Product(s) with such defects of conformity or proven faults and whose origin is attributable to "FRAGRANCE PUR" or reimburse the Buyer the amount of such Product(s), paid by the Buyer, if necessary.

If however, the parcel arrives damaged, incomplete, a defect is to be reported, or its non-receipt within the indicated time, " FRAGRANCE PUR " invites you to report this problem by e-mail " contact [at] fragrancepur.com " within 14 days.

An investigation will be conducted by "FRAGRANCE PUR" with the carrier and may take several days. During this period, no refund or return can be made. Once the results are known, if the fault is linked to the carrier or the manufacturer, the order will be replaced or refunded.

According to article 1386-1 of the Civil Code, only the manufacturer is responsible for the safety of the products. Only the suppliers guarantee that the products presented for sale are in conformity with the description communicated and that they do not present any hidden defect making them unsuitable for their normal use. The only contractual guarantee is the one granted by the supplier. "FRAGRANCE PUR" therefore declines all responsibility in the event of an error in the description of a product, taking into account the fact that the pictures and descriptions illustrating the products on sale are only indicative.

FRAGRANCE PUR" cannot be held responsible for any damage resulting from misuse or malfunction.
Furthermore, the responsibility of "FRAGRANCE PUR" cannot exceed the amount of the product ordered.
No compensation can be requested other than those provided for by the Consumer Code.
